The Chandler dentist who was arrested for carrying several weapons into the Ross-Blakley Law Library in January will likely sue the University and the ASU Department of Public Safety.
Bradley Kennedy, 45, initially faced weapons misconduct charges for bringing firearms into the library. He pleaded guilty to a lesser charge of disorderly conduct Thursday.
But Nicholas Hentoff, Kennedy's attorney, said ASU DPS officers had no reason to arrest his client, who had four loaded handguns and a folding pocketknife with him in the library.
"There was no basis to arrest him for misconduct with weapons," Hentoff said.
The campus is a weapon-free zone.
Hentoff said the possible lawsuit would follow the resolution of Kennedy's case involving unrelated sexual exploitation charges in Maricopa County Superior Court. Kennedy will be in court today for an initial pretrial conference.
According to state law, Kennedy has 180 days to file a claim against the officers involved.
Neither the University nor ASU DPS could comment on potential litigation.
After pleading guilty to disorderly conduct, Kennedy was sentenced to three years probation, ordered to serve 30 days in jail and ordered not to return to the campus while on probation.
"He really isn't a student and isn't a person with any business there," said Bill Fitzgerald, spokesman for the Maricopa County Attorney's Office.
