After nearly a semester of deliberation, ASU Student Life reprimanded Associated Student of ASU Executive Vice President Brian Buck with a series of sanctions.
As a result of the sanctions, Buck is barred from living on ASU property, is obligated to write apology letters and must perform 100 hours of community service.
While on permanent probation, Buck cannot disclose the any of the terms of his sanctions, which also require him to write a 20-page paper outlining his reflections on integrity and prohibit him from being employed by the University.
Buck's attorney, Dell James, said Wednesday that the punishments forced on Buck are "outrageous," and plans to fight them.
"The school has tried to fit Brian's actions into rules that don't fit," James said about the bachelor of interdisciplinary studies senior who was being punished for his involvement in the filming of the pornographic video "Shane's World #29: Frat Row Scavenger Hunt 3."
James added that ASU justified the sanctions by saying Buck was in violation of University rules for "misrepresenting oneself or organization or an agent of the University" and "unauthorized use of university property, resources or facilities."
Because the University punished Buck with sanctions, rather than expulsion or suspension, he has no option to appeal.
But James countered the University's statements and said without an appeals process, Buck's constitutional right to due process was violated.
"People may not agree with what Brian did," he said. "But that doesn't mean it was against the rules."
Honors College senator, Brandon Goad, who sponsored the first bill to oust Buck form office in September, said he was "very pleased" with the University's ruling.
"He hurt the reputation of ASU and ASASU," Goad said, who added that Buck's actions had compromised the effectiveness of ASASU.
James said a lawsuit against ASU is "definite."
"The University has picked on college kids that can't fight back," James said. "[A lawsuit] is the only way for us to fight back."
The University decline to comment.
