Tempe Police: Man sleeps at Tempe McDonald's


Tempe Police reported the following incidents Tuesday:

A Tempe man was arrested Oct. 29 near University and McClintock drives on suspicion of trespassing and aggravated assault, according to a police report.

The transient man was arrested after workers at the McDonald's said the man was sleeping in the restaurant after having been asked to leave multiple times, police reported.

Officers contacted the man at about 9 p.m. and said he had bloodshot, watery eyes and was agitated, police reported.

According to the police report, the man indicated he understood he would be arrested if he refused to leave but did not provide the officer with his name.

The officer told the man he was under arrest, and grabbed the man's right wrist, police reported. After the officer grabbed the man, the man cocked his fist as if he were going to punch the officer, according to the report.

The officer then handcuffed the man and searched his duffel bag, where he found a glass pipe with a burnt residue inside, police reported.

After officers read the man his Miranda rights, the man admitted to using methamphetamine days before, but upon his arrival at the jail, he said he was still under the influence of meth, according to the report.

The man said he did not remember being asked to leave the business or moving as though to punch the officer, despite having responded to the officer's questions before, police reported.

Records show the man said he was still "waking up" when the officer contacted him, according to the report.


A Tempe man was arrested Oct. 29 at Mill Avenue and Sixth Avenue on suspicion of shoplifting and possession of dangerous drugs, according to a police report.

Police contacted man after he stole a small amount of food from the Starbucks on Mill Avenue and Fifth Street, police reported.

The man entered the Starbucks around 7:30 a.m. and took a yogurt and a protein plate, at a total cost of $9.08, according to the report.

The man was arrested seven hours later near Mill Avenue and Sixth Street, police reported.

During the man's arrest, they found an aluminum packet of what they believed to be the synthetic marijuana drug "spice," according to the report.

During an interview with officers, the man admitted to buying and using the drug, police reported.
